TYLER, JOHN, President. Letter signed ("John Tyler") as Governor of Virginia, to Secretary of War James Barbour, Richmond, 29 June 1826. 1 1/2 pages, 4to, 250 x 200mm. (9 7/8 x 8 in.), integral address leaf, docketed on both integral leaf and verso, a few tears at folds, small seal hole. Governor Tyler urgently requests the return of two Virginia militia deserters: "The enclosed papers [not present] will inform you that two soldiers belonging to the Public Guard at this place and regularly enlisted therein, have deserted from the State Service, and have been enlisted in the Service of the United States at the Bellona Arsenal..,Major Loman the commanding Officer of the Arsenal...declines surrendering them upon the ground that his authority to do so is defective, and that the power to direct the surrender alone exists with the Department of War. I am confident that it is only necessary to bring this subject to your notice in order to effect the desired restoration. The consequences of a refusal would prove not only destructive of the discipline of this small State corps, a corps the existence of which is esteemed to be necessary for the preservation of the Public property at this place, and the secure confinement of convicts in the Public jail or Penitentiary, but would tend to its utter destruction..."
