MARSHALL ON A LEGAL WRANGLE. The future Chief Justice writes on an "unpleasant business" concerning a Mr. Brodhead and some certificates: "Means have been taken to procure testimony but...I fear we cannot use it...My brother William is I believe a witness...I hope too as he is going to Kentucky that he may take some depositions." He asks, "Can the commonwealth recover more than the damage it has sustained?", before concluding: "A separate writ is brought against Brodhead alone but...we have only undertaken that he shall carry them to the country & advertise that they are in his possession."
