An early copy of this seminal work on Maliki law composed by Averroes’s grandfather, Arabic manuscript on Spanish cream paper, each folio with 27ll. of black maghribi script, titles and important words in larger script, occasional marginal notes, incomplete at end, colophon of kitab al-istilhaq on f.4 indicating it is followed by kitab al-sharka, misbound, marginal repairs in 19th century Ottoman stamped burgundy morocco binding with flap

Ibn Rushd al-Jadd (d. 1136 AD) was the grand-father of Averroes (d. 1196 AD) and the author of a number of works on fiqh. Al-bayan wa al-tahsil is probably his most famous work and based on the Mustakhraja min al-asmi'a of Muhammad al-'Utbi al-Qurtubi (d. 868 AD). The Mustakhraja is an anthology of juridical questions compiled by al-'Utbi through sama' (listening) sessions by interpreters of Maliki doctrine. The present volume is an early copy of the work and was probably copied during the lifetime of Averroes or shortly after his death.
This manuscript is very close in style and date of copy to five volumes of
Al-Bayan wa al-Tahsil by Ibn Rushd al-Jadd which sold at Christie's South Kensington, 24 April 2015, lot 254
